New Jersey and New York Workers’ Construction Site Accidents

Scaffolding law and workers compensation

There are several legal options available for people injured on construction sites. In New York, section 240 of the New York labor law, known as the “Scaffolding Law,” allows workers injured in falls to bring an action against the employer or property owner for injuries sustained in a fall, whether the employer was at fault or not. Workers’ compensation laws in both New Jersey and New York provide compensation for workers injured during the course of their employment. Like the Scaffolding Law, workers’ comp laws apply whether or not the employer was at fault.

Third party and premises liability claims

Passersby who are injured because of a failure to guard a construction site properly may be able to file a slip and fall claim under premises liability law. In addition, workers hurt on construction sites by third parties who are not their employers—drivers of materials delivery trucks or the employees of a subcontractor—may be able to file a personal injury claim against the third party employer or employee.
